Why does the 'Live Help' button use the same design as if agents were online?

This is because of the settings of your contact button. 

Solution?:
In the agent panel of your LiveAgent navigate to 
Menu > Configuration > Chat buttons > click the particular chat button > scroll down to "Button design" > click "Customize design" > click "Use different design when chat is not available" > in the 'When chat is not available' section click Save.
